  2. The contract of sale governs the purchase and sale of the Seller’s online products (hereinafter the “Online Products”) through the electronic shop operated at the website www.lydkamethod.com.
  3. The Seller informs the Buyer about its following identification data:

Business Name: Language mentoring s.r.o.

  1. These Terms and Conditions have been drawn up in accordance with the laws of the Slovak Republic and are governed by them. If the Buyer is a consumer, this choice of law does not deprive the Buyer of the protection afforded by the mandatory provisions of the law of the country of the Buyer’s habitual residence. The supervisory authority is the Slovak Trade Inspection (Slovenská obchodná inšpekcia).

II. Online Product Order and Formation of Contract of Sale

  1. The Buyer places orders for Online Products in electronic form, by means of an electronic order made through the website www.lydkamethod.com. An electronic order is only valid if all prescribed data have been filled in. The e-mail address of the Buyer indicated in the order will be used for providing all information to the Buyer and is considered a durable medium within the meaning of Section 2(f) of Act No. 108/2024 Coll. on consumer protection, as amended (hereinafter the “Consumer Protection Act”). The order constitutes an offer to form a contract of sale. The contract of sale is considered formed once the Seller makes a binding acceptance of the Buyer’s offer. Binding acceptance of the order by the Seller means a notice of registration of the order sent to the Buyer’s e-mail address. By placing an order, the Buyer accepts the terms of delivery of the product declared by the Seller. The relationship between the Buyer and the Seller is governed by these Terms and Conditions, which are binding on both parties unless the contract provides otherwise.
  2. The contract of sale is concluded for a fixed term, which depends on the specific type of product purchased. Access to the product is provided to the Buyer for the period expressly stated on the sales page of the given product. For some products (e.g., e-books or selected video courses), access is provided for an indefinite period (so-called lifetime access), which applies for as long as the platform or the Buyer’s account exists, or for as long as the Seller is entitled to operate the given product. The Seller reserves the right to restrict or terminate access to electronic content for technical or legal reasons.
  3. The contract of sale is not renewed automatically. After it expires, it terminates without the need for notice. This does not apply to membership products, which are governed by Article IX.

III. Intellectual Property Rights and Terms of Licence

  1. If the ordered Online Product represents electronic content, such electronic content is protected by the applicable provisions of Act No. 185/2015 Coll., the Copyright Act, as amended (hereinafter the “Copyright Act”). The Seller is its author, and by entering into a contract of sale the Buyer accepts the terms of licence with respect to such electronic content as specified herein, where the Seller acts as the licensor and the Buyer acts as the licensee and acknowledges that the electronic content is subject to the provisions of the Copyright Act.
  2. The licensor grants the licensee a non-exclusive right to create and store a reasonable number of copies of the concerned electronic content, which can be viewed, reasonably used or otherwise projected by the licensee without limitation as to the number of such instances of use, however, always only for its own non-commercial purpose. The licensee may use the electronic content on any device that allows such use; the licensor does not grant any warranty for usability of its electronic content on any particular technical device.
  3. The licensee may not sell, lease, lend or share in any manner, distribute, broadcast, sublicense or grant rights in any other manner to any third party, either to the electronic content in its entirety or to its part. The licensee shall preserve the marks used for the concerned electronic content identifying the authorship of the licensor. The licensee also undertakes not to enable third parties to violate the copyright of the licensor to the concerned electronic content in any manner, and in case of such violation the licensee undertakes to notify the licensor about such circumstance.
  4. The licensee acknowledges that upon payment of the price for the Online Product, no rights and obligations of the author under the Copyright Act are transferred to the licensee, with the exception of rights and obligations relating to authorized use of the electronic content in accordance with these terms of licence and with the Copyright Act.

IV. Price and Payment Conditions

  1. Prices for Online Products published on the website of the Seller www.lydkamethod.com are effective and valid at the time of ordering. Prices are stated as final and no fees are added to them. The Buyer purchases an Online Product for the price indicated on the website at the time of placing the order. The Seller reserves the right to correct any apparent misprints.
  2. The price is considered paid once the complete purchase price has been credited to the Seller’s account. The invoice drawn pursuant to the contract of sale between the Seller and the Buyer is sent to the Buyer in electronic form. Upon request of the Buyer, an invoice may also be sent by mail.
  3. The Buyer may only use the Online Product after complete payment of the purchase price, unless otherwise agreed. If the Buyer fails to pay the price for the Online Product to the Seller in the amount and under the terms agreed in the contract of sale, the Seller may withdraw from the contract of sale.
  4. The Buyer pays the price of the product by payment card through the Stripe payment gateway.

V. Right to Withdraw from the Contract and Complaints

  1. The Buyer has the right to withdraw from the contract of sale, even without specifying grounds for withdrawal, within fourteen (14) calendar days after receiving the Online Product.
  2. The Buyer shall notify the Seller of the withdrawal from the contract, indicating the number of the invoice concerning the purchase of the respective Online Product. Withdrawal from the contract may be made using the online withdrawal form at www.lydkamethod.com/withdrawal/ or by sending an e-mail message to the e-mail address of the Seller: [email protected].
  3. If the Buyer withdraws from the contract using the online withdrawal form or by means of an e-mail message, the Seller shall send the Buyer a confirmation of receipt of the withdrawal by e-mail immediately after receiving it. If the online withdrawal form is used, the confirmation includes the content of the withdrawal and the date and time of its submission.
  4. The Seller shall, without undue delay, however at the latest within fourteen (14) calendar days after receiving a valid notice of withdrawal from the contract, return to the Buyer all payments obtained under the contract or in connection with it.
  5. The Seller reserves the right to apply the exception under Section 19(1)(m) of the Consumer Protection Act, under which the Buyer has no right to withdraw from the contract if its subject is the supply of digital content (for example an e-book, a video course or other online content) not supplied on a tangible medium, provided that at the same time:
    a) the Buyer has expressly consented to the start of the supply of the digital content before the expiry of the withdrawal period,
    b) the Buyer was duly informed that by giving this consent the Buyer loses the right of withdrawal, and
    c) the Seller provided the Buyer with confirmation of the granting of this consent and of the information pursuant to Section 17(12)(b) or (13)(b) of the Consumer Protection Act.
  6. Online Products purchased through the electronic shop www.lydkamethod.com are subject to a statutory warranty period of twenty-four (24) months. The Seller is responsible for ensuring that the content of the product is in conformity with the contract of sale, has the agreed properties and complies with the applicable legal regulations. The warranty period commences upon the conclusion of the contract, that is, at the moment when the Buyer pays for the Online Product and receives it from the Seller.
  7. Any potential complaint shall be made by the Buyer to the Seller. The Buyer shall file the complaint in electronic form to the e-mail address of the Seller [email protected]. The same address is also applicable for sending any suggestions or claims with respect to a concluded contract.
  8. Immediately after filing of a complaint, the Seller shall send a confirmation of receipt of the complaint to the Buyer by an e-mail message.
  9. As a result of liability of the Seller for defects of sold goods, the Buyer has the following rights:
    a) In case of a remediable defect, the Buyer has the right to require free-of-charge, timely and complete repair of the defect. The Seller shall remedy the defect without undue delay. Instead of claiming repair of the defect, the Buyer may claim replacement of the Online Product or, in case the defect affects only a part of the Online Product, replacement of the affected part, provided that such replacement does not result in unreasonable expenses of the Seller, taking into consideration the price of the product or the gravity of the defect.
    b) In case of a non-remediable defect which prevents due usage of the Online Product in the same manner as a product without defects, the Buyer has the right to replacement of the Online Product or the right to withdraw from the contract. The same rights apply to the Buyer in case of remediable defects which prevent the Buyer from properly using the product as a result of repeated occurrence of defects after their repair or as a result of occurrence of numerous defects. In case of other non-remediable defects, the Buyer has the right to a reasonable discount from the purchase price.
  10. The Seller shall determine the manner of handling the complaint immediately, in complicated cases at the latest within three (3) working days after filing of the complaint, in justified cases at the latest within thirty (30) days after filing of the complaint. After determination of the manner of handling the complaint, the complaint shall be resolved immediately; in justified cases the complaint can be resolved even later; however, the period for resolving the complaint of a Buyer who is a consumer may not exceed thirty (30) days after filing of the complaint. Such period of thirty (30) days for resolving the complaint is not binding in case of a Buyer whose relationship with the Seller is governed by the Commercial Code.
  11. Complaints concerning Online Products are governed by the provisions of the Civil Code (Act No. 40/1964 Coll.) and the Consumer Protection Act.
  12. If the Buyer who is a consumer is not satisfied with the way the Seller has handled the complaint, or believes that the Seller has violated the consumer’s rights, the consumer has the right to contact the Seller with a request for redress. If the Seller rejects the request for redress or does not respond to it within thirty (30) days of its being sent, the consumer has the right to file a proposal to initiate alternative dispute resolution pursuant to Act No. 391/2015 Coll. on alternative dispute resolution as amended. The register of bodies for alternative dispute resolution is administered by the Ministry of Economy of the Slovak Republic and is available online at https://www.mhsr.sk/. In addition to alternative dispute resolution, the consumer has the right to claim protection at a competent court.

VI. Gift Vouchers

  1. Language mentoring issues gift vouchers.
  2. The gift vouchers are of different nominal values, equivalent to their purchase price for which they can be acquired and which is clearly stated in the order form as well as clearly identifiable from the visual design of the vouchers themselves (hereinafter the “value of the voucher”).
  3. The gift voucher is delivered in electronic form via e-mail and each voucher is linked to its own unique code. The gift voucher is considered delivered on the day of receipt by the Buyer of the e-mail containing the voucher with the unique code.
  4. The gift voucher may be used to purchase any Language mentoring product during the period of validity of the voucher, and there is an entitlement to deduct the value of the voucher from the purchase price of the given product. The gift voucher must be used before finalizing the order of the given product by sending an e-mail to [email protected] and stating the unique code linked to the gift voucher in question. The entitlement to deduct the value of the voucher from the purchase price is linked to the gift voucher and may be claimed by any person who is the holder of the voucher.
  5. The buyer of the gift voucher has the right to withdraw from the contract of sale within 14 days after the delivery of the gift voucher, even without stating a reason, provided that the voucher has not yet been used.
  6. The buyer may file a complaint against the Seller in case of receiving a faulty voucher.
  7. The provisions of Article V of these Terms and Conditions apply to the processes of withdrawal from the contract and filing a complaint.
  8. The gift vouchers have a limited period of validity. A gift voucher may only be used within the period of its validity, after which the entitlement to use the voucher shall cease.
  9. A person who used a voucher to pay for part of the price of the Seller’s product is entitled to use their legal right to withdraw from the contract of sale within 14 days of receiving the purchased product according to Article V(1) et seq. of these Terms and Conditions, and in such a case the amount covered by the gift voucher shall be returned to this person in the form of a gift voucher.
  10. In case of loss, destruction or damage of the gift voucher, the Seller shall not be obliged to ensure its replacement.
  11. The gift voucher may only be used once and it may not be returned, with the exception of exercising one’s legal right of withdrawal from the contract.
  12. The gift voucher is not exchangeable for money.
  13. More than one gift voucher may be used to purchase one product, and a gift voucher may also be used to purchase discounted products.

VII. Delivery of Online Product

  1. The period for delivery of Online Products begins immediately after the Seller receives payment. Delivery of an Online Product means sending of the access data to the Online Product by the Seller to the e-mail address of the Buyer indicated in the order. The day on which the access data are delivered by e-mail is considered the day of receipt of the Online Product.
  2. For products that are courses with a time-limited duration, the delivery period is tied to the specified start of the course.

VIII. Technical Requirements, Functionality, Compatibility and Protection of Digital Content

  1. The digital content within the delivered products is provided in the form of streamed videos, PDF documents and texts on the Seller’s websites or through other online platforms intended for the distribution of digital content (e.g., member sections, learning systems, messaging applications). To use it, the following is required:
    a) a working e-mail address,
    b) internet access,
    c) a device with a current web browser (e.g., Chrome, Firefox, Safari) that supports video playback and the display of PDF documents.
  2. Access to the digital content may be tied to a personal login to a user account and is intended exclusively for the Buyer’s personal use.
  3. The digital content may be protected by technical means against unauthorized copying, downloading or distribution (e.g., password protection, time-limited access, disabled video downloads).
  4. The digital content is compatible with standard web browsers (e.g., Google Chrome, Mozilla Firefox, Safari) and operating systems (e.g., Windows, macOS, Android, iOS). If the content includes recommendations to use third-party applications or programs, a specific operating system with which the best compatibility or functionality is ensured may be stated.

IX. Special Terms for Membership Products

  1. The Seller offers two separate membership products: Lydka SAIL (intended for clients from a slightly advanced language level) and Lydka BOAT (intended primarily for beginners). The basis of the membership is the availability of the AI language mentor ALMI SAIL or ALMI BOAT, depending on the type of product purchased. Each of these products is a separate and independent product. By purchasing one membership product, the Buyer acquires no entitlement to access the other membership product or to use it in part. Transition between membership products, their mutual exchange, or the transfer of a membership from one product to another are not possible as a rule, and the Seller is not obliged to allow such a change.
  2. In addition to the AI language mentor ALMI SAIL, the Lydka SAIL product also includes the LydkaSpeak application. Access to LydkaSpeak begins and ends together with the Lydka SAIL membership. The specific composition of each product, in particular which tools and additional services are part of it, is stated on the sales page of the given product at the time of the order.
  3. The Buyer is entitled to purchase a membership in the selected membership product (Lydka SAIL or Lydka BOAT) (hereinafter the “membership”) for a period of one (1) month, six (6) months or twelve (12) months. Each month of the membership entitles the Buyer to a certain number of messages that the Buyer can use in communication with ALMI, depending on which version of the product the Buyer has purchased. The number of messages counts both messages sent by the Buyer and messages received from ALMI. The exact number of messages included in a specific membership package is always stated on the Seller’s sales page when the given package is ordered. After the specified number of messages has been used up within one month of the membership, the Buyer is not entitled to further messages beyond the purchased package. After the relevant monthly period ends, the number of messages is renewed according to the terms of the purchased package.
  4. The price of the membership for a period of one (1), six (6) or twelve (12) months is payable in a single payment in advance by online payment by payment card, and the membership is activated at the moment the payment is successfully processed.
  5. After the prepaid period of the membership (1, 6 or 12 months) ends, the membership automatically changes into a monthly membership with a monthly price corresponding to the average monthly price of the purchased package. The Buyer hereby acknowledges and agrees that, from that moment, the monthly subscription will be charged and invoiced every month, with the relevant amount automatically deducted from the payment card with which the first payment was made, or from another payment card designated by the Buyer. If the relevant amount cannot be successfully charged to the Buyer’s payment card, the Seller will make two further attempts at payment. If these attempts are also unsuccessful, the subscription will be automatically cancelled.
  6. If the Buyer purchases a monthly membership, the price of the monthly membership is charged every month until it is cancelled by the Buyer.
  7. The Buyer is entitled to cancel the subscription at any time:
    a) by sending the command “/stop” in the chat with the AI language mentor ALMI SAIL or ALMI BOAT (depending on which version the Buyer has purchased), or
    b) by sending an e-mail to [email protected].
  8. Cancellation of the subscription takes effect after the end of the period for which the membership has already been duly paid and activated. The Buyer has no entitlement to a refund for a period that has already been paid and during which the Buyer had access to the membership.
  9. A prepaid membership (for 1, 6 or 12 months) cannot be paused, interrupted or changed during the agreed prepaid period (in particular, its length, package type or number of messages cannot be changed). The Buyer is entitled to cancel the membership in the manner set out in this Article; the cancellation takes effect after the end of the period already paid, and the Buyer has no entitlement to a refund or to a transfer of the unused period.
  10. 14-day money-back guarantee. The Seller provides a guarantee for membership products: if the Buyer is not satisfied with the membership, the Buyer may request a refund by sending an e-mail to [email protected] within fourteen (14) calendar days of the first purchase of the membership, without giving a reason. The Seller will refund the full price paid, regardless of the membership package chosen, without undue delay and at the latest within fourteen (14) days of receiving the request; the membership ends on the day the refund is made. The guarantee applies only to the first purchase of a membership; it does not apply to automatic renewals of the membership under paragraph 5 of this Article or to additional message packages under Article X. The guarantee applies regardless of the exception under Article V(5) of these Terms and Conditions.
  11. The provisions of these Terms and Conditions concerning the Buyer’s statutory right to withdraw from the contract and the guarantee under paragraph 10 are not affected by the other provisions of this Article.

X. Additional Message Packages for Membership Products

  1. The Buyer is also entitled to purchase an additional message package beyond the number of messages included in the regular membership package of the relevant membership product.
  2. The additional message package is not tied to individual months but to the entire period of the Buyer’s active membership. The Buyer is entitled to use messages from the additional package throughout the period of the active membership, until the number of messages included in the additional package has been used up in full.
  3. Messages from the monthly limit of the purchased package are used first. Messages from the additional package are deducted only after the monthly message limit for the given month has been fully used up, and they carry over to the following month until the membership in the relevant membership product ends.
  4. If the Buyer does not use all the messages from the additional package during the active membership, these messages expire after the membership ends, with no entitlement to a refund of the price paid for the additional package.
  5. The exact number of messages and the price of the additional package are always stated on the Seller’s sales page.

XI. Bonus Products and Additional Services for Membership Products

  1. Besides the main product (the membership), the Seller may also provide free bonus products and additional services (for example the Learning Tracker, study materials, webinars and the like) according to the current offer stated on the sales page of the given product.
  2. Bonus products and additional services are provided as a free supplement to the main product, the membership. The Seller reserves the right to change the scope, content or availability of the bonus products and additional services, including during the Buyer’s membership.

XII. Liability and Restrictions on the Use of Membership Products

  1. The membership products (Lydka SAIL and Lydka BOAT) are artificial intelligence tools intended to support the process of learning foreign languages and make it more enjoyable. They are informational in nature and do not replace professional advice. The Seller is not liable for inaccuracies, incompleteness or errors in the responses generated by ALMI, nor for the results the Buyer achieves when using it. Results in learning foreign languages are individual and depend on several factors that are not under the Seller’s control.
  2. The Buyer acknowledges that the membership products depend on third-party technologies, and their availability may be limited or interrupted for reasons beyond the Seller’s control. The Seller is not liable for outages, interruptions or restrictions of functionality caused by circumstances it cannot influence.
  3. The Buyer undertakes to use the membership products solely for the purposes for which they are intended and to refrain from any misuse of the service, in particular from entering unlawful or otherwise inappropriate content.
  4. The Seller is not liable for damage incurred by the Buyer as a result of incorrect use of the membership products or as a result of relying on content generated by artificial intelligence, if this content was used for a purpose other than the one for which it is intended.

XIII. Final Provisions

  1. These Terms and Conditions apply in the version published on the website of the Seller www.lydkamethod.com on the date the Buyer sends the electronic order, unless otherwise agreed in writing by the parties. By sending the electronic order, the Buyer accepts without reservation all provisions of these Terms and Conditions in the version in effect on the date of sending the order, and accepts the valid prices of the ordered goods as specified in the price list on the website www.lydkamethod.com, unless otherwise demonstrably agreed in a particular case.
  2. Relationships between the parties which are not regulated in these Terms and Conditions are governed by the applicable provisions of the Civil Code, the Consumer Protection Act, Act No. 22/2004 Coll. on electronic commerce as amended, and other applicable legislation under Slovak law. If the Buyer is an entrepreneur, its relationship with the Seller is governed by the Commercial Code (Act No. 513/1991 Coll.).
  3. If any of the provisions of these Terms and Conditions becomes ineffective, invalid or unenforceable, the validity, effectiveness or enforceability of the other provisions shall remain unaffected.
  4. The Seller and the Buyer fully acknowledge the electronic form of communication, made primarily through e-mail and the internet, as a valid form of communication binding on both parties.
  5. These Terms and Conditions come into force on 13 March 2018 and were last amended on 20 October 2026.
